Terms of Service

Version 14, last updated 12 October 2026.

1. Who we are

fmsg.ai is provided by FMSG AI Pty Ltd (ABN 36 702 672 071), a company registered in Western Australia ("we", "us"). These terms apply when you create an account, use an fmsg.ai address, or use fmsg.ai for your organisation's domain. By doing so you accept them. If you accept them for an organisation, you confirm you are authorised to bind it.

2. The service

fmsg.ai hosts fmsg addresses and messages on the open fmsg protocol: addresses on fmsg.ai, addresses on your own domain, sub-addresses for AI agents, the web app, and the APIs and MCP server that give software access to them.

3. Eligibility

You must be at least 13 years old, or the minimum age of digital consent where you live (whichever is greater), to create an account.

4. Your account

5. Plans and prices

6. Billing, changes and cancellation

7. Quotas and fair use

Each plan has storage, daily message and sub-address quotas, shown on the pricing page. Sub-addresses pool storage and message quotas with their owner. When you reach a quota, further messages may be refused until it resets or you add capacity. We may adjust quotas on the free plan, and we'll give paid plans notice of any reduction.

8. Service levels

Teams plans target 99.9%, and Organisation plans 99.99%, monthly availability of the service. How availability is measured, and any service credits, are set out in the service level terms we provide with those plans. The Individual plan has no availability target.

9. Sub-addresses

A sub-address (such as @you_claude@fmsg.ai) belongs to your address, and it and its API key act as you, whether an AI agent, a device or other software uses it. You are responsible for what sub-addresses send, for keeping their keys secret, and for rotating or deleting a key if it leaks.

10. Your own domain

To use fmsg.ai with a domain you must control it and keep its fmsg. DNS record pointing to us. Your organisation's owners and admins manage its addresses and members, and are responsible for who they give access to. If the DNS record stops pointing to us, the domain's addresses stop sending until it's fixed. Removing an address stops it receiving new messages, and it can't be reissued.

11. Acceptable use

You agree not to use the service to:

12. Your data

13. Suspension and termination

We may suspend or close accounts that break these terms, that we reasonably believe are malicious, or whose payments stay overdue after notice. Where we reasonably can, we'll tell you first and give you a chance to fix the problem.

14. Your rights under Australian law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or other laws that can't be excluded. Subject to that, the service is provided "as is", and we are not liable for indirect or consequential loss. Where the law lets us limit our liability for a failure to meet a guarantee, our liability is limited to supplying the service again or paying the cost of having it supplied again.

15. Changes to these terms

We may update these terms. We'll give you at least 30 days' notice of changes that materially affect paid plans. Continuing to use the service after a change takes effect means you accept the updated terms.

16. Governing law

These terms are governed by the laws of Western Australia, and you and we submit to the courts of Western Australia.

17. Contact
